Terms of Service

These Terms govern your use of the SUP Android app and the SUP website (together, the Service). By creating an account or using the Service you agree to them. If you do not agree, do not use the Service.

1. What SUP Is

SUP is a marketplace for used goods. It puts buyers and sellers in touch and gives them a place to talk. That is the whole of what it does.

• SUP takes no commission. We do not take a percentage of what an item sells for, from the buyer or the seller. There is no listing fee and no cut when something sells.
• SUP does not handle the money. Payment for an item passes directly between buyer and seller. SUP is not an escrow, a payment intermediary or a guarantor of any transaction.
• SUP does not set the price. The seller sets the price, and the two of you agree what is finally paid.
• SUP is not a party to the sale. The contract for an item is between the buyer and the seller. SUP does not own, inspect, store, test, ship or guarantee any item listed on it.

SUP does charge for some of its own optional features. Those are separate from the sale of an item and are covered in section 6.

2. Who May Use SUP

You must be 18 or over. By using the Service you confirm that:

• you are at least 18 years old;
• you can enter into a binding contract;
• no law prohibits you from using the Service;
• you will use it lawfully.

3. Your Account

• Give accurate information when you register, and keep it current.
• Keep your password and app passcode to yourself. You are responsible for what happens under your account.
• Tell us straight away if you think someone else has got into it.
• Do not create accounts automatically or under a false identity.

You can delete your account at any time in the app: Settings → Privacy Settings → Delete Account. What happens to your information afterwards is set out in the Privacy Policy.

4. Posting An Ad

4.1 Your Responsibilities

Everything in your Ad is yours. When you post one you confirm that:

• you own the item, or are authorised to sell it;
• the title, description, condition and category are accurate and not misleading;
• the photos are of the actual item you are selling, and are yours to upload;
• the price is genuine;
• the location you give is the area the item is actually in;
• selling the item is lawful.

Remove or mark your Ad as sold once the item has gone, and reply to people who message you about it.

4.2 How An Ad Goes Live

Every Ad is read by a person before it appears. A free Ad is normally live within 8 hours. You do not pay anything to post one, and there is no limit tied to payment.

If you would rather not wait, SUP sells an option that publishes the Ad immediately. It is still reviewed afterwards, and it can still be taken down if it breaks these Terms. See section 6.

4.3 What You May Not List

• Illegal goods or substances, including controlled drugs.
• Counterfeit, replica or stolen goods.
• Weapons, firearms, ammunition or explosives.
• Adult content or services.
• Live animals, or products from endangered species.
• Prescription medicines or regulated medical devices, without authorisation.
• Alcohol and tobacco products.
• Financial instruments and personal financial accounts, including cards, bank accounts and SIM cards registered to someone else.
• Pirated software, media or other digital goods.
• Anything whose sale is restricted or prohibited under Indian law.

We remove Ads that break this, and we suspend accounts that do it repeatedly or deliberately.

5. How You Must Behave

You agree not to:

• mislead another user about an item, a price or who you are;
• post a fraudulent Ad, or attempt a scam of any kind;
• impersonate another person or business;
• ask a buyer for an advance payment, a token amount or a deposit before they have seen the item;
• harass, threaten or abuse anyone in chat;
• send unsolicited or bulk messages;
• post the same Ad repeatedly, or use Ads to advertise something else;
• manipulate ratings, or leave a review for a deal that did not happen;
• misuse a paid feature, including buying promotion for an Ad that breaks these Terms;
• scrape or bulk-extract data from the Service;
• try to get around account limits, security controls or a suspension;
• upload malicious code, or interfere with how the Service runs.

Report anything that breaks these rules from the Ad or the profile. We read every report.

6. SUP's Own Paid Features

SUP is free to use. Posting Ads, browsing, chatting and selling cost nothing, and no commission is ever charged on a sale.

Separately, SUP sells a few optional features of its own. When you buy one you are paying SUP for a service on the platform — you are not paying a fee on the item you are selling.

• Verified User — a verification badge on your profile and your Ads, for a fixed period, together with the other benefits shown on the purchase screen.
• Publish now — your Ad goes live immediately instead of waiting for review.
• Home screen placement — one of your Ads is shown on the home screen for a period.

Prices, durations and benefits are the ones shown in the app on the purchase screen at the time you buy. They are not repeated here, so that this page cannot go out of date and contradict what you were charged. Payment is taken in Indian Rupees through our payment provider.

6.1 Verified User

• It is a SUP platform service. It confirms an identity check with SUP. It is not a guarantee by SUP of any user, any item or any deal, and it does not make SUP a party to a sale.
• It starts once payment succeeds and verification is complete, and runs for the period shown when you bought it.
• It does not renew automatically. Nothing is charged again unless you buy it again.
• It may be withdrawn without refund if the account is suspended for breaking these Terms, or if the verification turns out to be false.

6.2 Promotional Placement

• You are buying placement and visibility, not a result. SUP does not promise that an Ad will sell, or sell for any price, or receive any number of views or enquiries.
• A promoted Ad follows the same rules as any other. It is still reviewed, and it is removed without refund if it breaks these Terms.
• Placement is subject to availability and to where the feature has been made available.

6.3 Refunds

Refunds and cancellation for these features are covered by the Return & Refund Policy. That policy applies to what you buy from SUP. It does not apply to an item you buy from a seller, because SUP is not a party to that sale and never held the money.

7. Buying And Selling Between Users

The deal is between you and the other person. Please take it seriously:

• Inspect the item yourself before you pay for it.
• Meet in a busy public place. Tell someone where you are going. Take someone with you for anything valuable.
• Do not pay in advance for something you have not seen, however convincing the reason.
• Agree in the chat, before you meet, what happens if the item is not as described. That written record is the only one that exists.
• Check documents and proof of ownership for anything that has them, such as a vehicle or a phone.

SUP cannot refund you for an item, reverse a payment, or force a seller to take something back. We never received the money. What we can do is act on the account: we remove Ads and suspend users who break these Terms. That is enforcement, not a remedy for your loss.

8. Your Content

You keep ownership of everything you post — your photos, descriptions, messages and reviews. SUP does not claim ownership of your content or of the items you sell.

So that we can actually run the Service, you give SUP a non-exclusive, royalty-free licence to store, copy, resize, format and display your content, for the purpose of operating and promoting the Service and your Ads within it. It lasts while your content is on SUP, and it ends when the content is removed, except for copies kept in backups or where we must retain something for a legal reason.

You confirm you have the rights to everything you upload. We may remove content that breaks these Terms or the law.

9. Reviews And Ratings

• Only review a deal you actually took part in.
• Be honest and specific.
• Do not use extra accounts or arrangements with other users to move a rating.

We remove reviews that break these Terms.

10. Suspension And Termination

We may suspend or close an account that breaks these Terms or the law, or where it is necessary to protect other users. Where we reasonably can, we will say why. You may close your account at any time. A closed account does not entitle you to a refund of a paid feature, except as the Return & Refund Policy provides.

11. Availability

The Service is provided as it is and as available. We do not promise it will be uninterrupted or fault-free, and we may change or withdraw features. See the Disclaimer for the detail.

12. Limitation Of Liability

To the extent the law allows, SUP is not liable for indirect or consequential loss, or for loss of profit, data or goodwill, arising from your use of the Service or from a deal between users.

Where SUP is found liable to you, our total liability is limited to the greater of the amount you paid SUP for its own services in the twelve months before the claim, or ₹1,000.

Nothing here limits liability that cannot be limited by law, including your rights under the Consumer Protection Act, 2019 in respect of services you buy from SUP.

13. Indemnity

You agree to cover SUP against claims, losses and reasonable costs arising from your use of the Service, your breach of these Terms, or your infringement of someone else's rights.

14. Governing Law And Disputes

These Terms are governed by the law of India. Please write to us first — most problems are settled that way. If a dispute cannot be resolved, it will be referred to arbitration under the Arbitration and Conciliation Act, 1996, seated in India and conducted in English. Either party may still apply to a court for urgent interim relief.

15. Changes To These Terms

We may change these Terms. The date at the top says when they last changed. For a material change we will give notice in the app or by email before it takes effect. Continuing to use the Service after that means you accept the change.
