Welcome to SUP. These Terms of Service ("Terms") govern your access to and use of the SUP mobile application and website (the "Service") operated by SUP ("we", "our", or "us"). By downloading, installing, or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service.

1. Eligibility

You must be at least 18 years of age to use SUP. By using the Service, you represent and warrant that:

You are at least 18 years old
You have the legal capacity to enter into a binding contract
You are not prohibited from using the Service under any applicable law
You will use the Service only for lawful purposes

2. Account Registration

To access most features of SUP, you must create an account. You agree to:

Provide accurate, current, and complete information during registration
Maintain and promptly update your account information
Keep your password and passcode confidential
Notify us immediately of any unauthorized access to your account
Be responsible for all activities that occur under your account

You may not create accounts using automated means or under false pretenses. We reserve the right to suspend or terminate accounts that violate these Terms.

3. The SUP Marketplace

SUP is a peer-to-peer marketplace platform that enables users to buy and sell second-hand and new goods. We act solely as a platform facilitating connections between buyers and sellers. SUP is not a party to any transaction between users.

3.1 Listing Rules

When creating listings, you agree to:

Only list items you own and have the right to sell
Provide accurate descriptions, conditions, and prices
Use only real, unedited photos of the actual item
Set a fair price (price manipulation is prohibited)
Remove listings once an item is sold
Respond to buyer inquiries in a timely manner

3.2 Prohibited Items

You may not list the following on SUP:

Illegal goods or substances, including controlled drugs
Counterfeit, replica, or stolen goods
Weapons, firearms, ammunition, or explosives
Adult content or services
Live animals or endangered species products
Prescription medicines or medical devices without authorization
Alcohol or tobacco products
Personal financial instruments (credit cards, bank accounts)
Pirated software, media, or digital goods
Any item the sale of which is prohibited under Indian law

4. User Conduct

You agree not to:

Harass, threaten, or intimidate other users
Post false, misleading, or defamatory content
Spam users with unsolicited messages or listings
Attempt to circumvent the platform by taking transactions off-app
Create fake accounts or misrepresent your identity
Scrape, crawl, or systematically extract data from the Service
Introduce viruses, malware, or other malicious code
Interfere with the integrity or performance of the Service
Attempt to gain unauthorized access to any part of the Service

5. Transactions and Payments

SUP does not process payments between users. All financial transactions are conducted directly between buyers and sellers. We strongly recommend:

Meeting in safe, public places for in-person exchanges
Verifying items before completing payment
Using traceable payment methods (UPI, bank transfer) rather than cash for high-value items
Never paying in advance without verifying the seller's reputation

SUP bears no responsibility for disputes, fraud, or failed transactions between users.

6. Fees

SUP is currently free to use with no listing fees or commissions. We reserve the right to introduce fees in the future with reasonable notice to users. Continued use after fee implementation constitutes acceptance.

7. Intellectual Property

The SUP name, logo, app design, and all original content on the platform are owned by us and protected by intellectual property laws. By posting content on SUP, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content solely for operating and improving the Service.

You retain ownership of the content you post. You represent that you have all necessary rights to grant this license.

8. Reviews and Ratings

The review system is intended to build trust in the community. You agree to:

Only submit reviews for transactions you actually completed
Provide honest, accurate feedback
Not manipulate ratings through fake accounts or coordinated activity

We reserve the right to remove reviews that violate these Terms.

9. Termination

We may suspend or terminate your account at any time, with or without cause, including if we believe you have violated these Terms. You may delete your account at any time through the app settings. Upon termination, your right to use the Service immediately ceases.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SUP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR ANY TRANSACTIONS BETWEEN USERS. OUR TOTAL LIABILITY SHALL NOT EXCEED ₹1,000 (ONE THOUSAND RUPEES).

12. Indemnification

You agree to indemnify and hold harmless SUP and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes shall be resolved through binding arbitration under the Arbitration and Conciliation Act, 1996, with proceedings conducted in English. The seat of arbitration shall be India. Nothing herein prevents either party from seeking injunctive relief from a competent court.

14. Changes to Terms

We may modify these Terms at any time. We will provide 30 days' notice for material changes via email or in-app notification. Continued use after the effective date constitutes acceptance of the modified Terms.
